Quotes and proposals may be subject to expiration dates, manufacturer terms, product availability, freight, taxes, project requirements, and other conditions stated in the applicable document.

An order is subject to acceptance and any applicable written acknowledgment, quote, proposal, invoice, manufacturer requirement, or other transaction document. If these website Terms conflict with a specific written quote, proposal, order acknowledgment, contract, or other agreement issued or accepted by Air Control Products for a transaction or project, the terms of that specific written document will control to the extent of the conflict.

Pricing, Taxes, and Payment Terms

Pricing shown on the Site, if any, is informational unless expressly stated otherwise. Prices may change based on manufacturer pricing, specifications, quantities, freight, tariffs, taxes, project conditions, or other factors. Applicable taxes, delivery charges, freight, surcharges, and other costs may be added as provided in the applicable quote, proposal, invoice, or agreement. Payment terms are governed by the applicable transaction documents and are not modified by these website Terms.

Product Availability and Lead Times

Product availability and lead times are estimates unless expressly guaranteed in writing. Manufacturing schedules, supply-chain conditions, material availability, transportation, labor, weather, regulatory requirements, and other circumstances may affect availability or delivery. Air Control Products is not responsible for manufacturer or carrier delays except to the extent expressly stated in a written agreement.

Shipping, Delivery, and Freight

Shipping method, delivery location, freight charges, delivery responsibilities, risk of loss, and related terms will be governed by the applicable quote, proposal, order acknowledgment, manufacturer terms, or other written transaction documents. Delivery dates are estimates unless expressly guaranteed in writing.

Order Changes, Cancellations, and Returns

Requests to change or cancel an accepted order, or to return products or equipment, are subject to Air Control Products' written approval and any applicable manufacturer or supplier policies. Custom, special-order, fabricated, configured, or non-stock products may be noncancelable or nonreturnable. Approved changes, cancellations, or returns may be subject to restocking charges, cancellation charges, freight, handling, or other costs imposed by the manufacturer, supplier, or carrier. Any applicable terms will be determined based on the specific order and controlling transaction documents.

Meetings, Site Visits, and Project Appointments

When a meeting, site visit, or project-support appointment is scheduled, we will make reasonable efforts to accommodate the agreed date and time. If you need to cancel or reschedule an appointment, please contact us at least 24 hours in advance when practicable. This 24-hour request applies to appointments and does not create a right to cancel an accepted product order.

Project, Application, and Engineering Support

Air Control Products may provide product-selection assistance, application information, system-design support, coordination, and other project collaboration. Unless Air Control Products expressly agrees otherwise in a signed written agreement, information or support provided through the Site or in ordinary communications is intended to assist project participants and does not replace the responsibilities of the project owner, architect, engineer of record, contractor, installer, or other licensed or responsible professional to verify design, code compliance, suitability, installation requirements, and project-specific conditions.

Users are responsible for reviewing applicable plans, specifications, submittals, manufacturer instructions, codes, and contract requirements before relying on product or application information.

Warranties and Guarantees

Products and equipment supplied by Air Control Products may be covered by warranties provided by the applicable manufacturer. Manufacturer warranties are subject to the manufacturer's terms, conditions, exclusions, claim procedures, and available remedies. Matters such as repair, replacement, labor, freight, removal, reinstallation, and other costs are governed by the applicable manufacturer warranty unless Air Control Products expressly agrees otherwise in writing.

Any warranty or guarantee offered directly by Air Control Products for project support or services is limited to the terms expressly stated in the applicable quote, proposal, invoice, contract, or other written agreement. Unless otherwise stated in writing, Air Control Products does not provide warranties beyond applicable manufacturer warranties or warranties specifically agreed to by Air Control Products in writing. If you have a warranty question or claim, contact us and we will provide reasonable assistance in identifying and coordinating applicable warranty coverage.

Limitation of Liability

Except as otherwise provided in an applicable written agreement, and to the fullest extent permitted by law, Air Control Products will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising out of or related to the Site or the products, equipment, information, or services described on the Site. To the fullest extent permitted by law, Air Control Products' aggregate liability for a claim arising from a specific product or service will not exceed the amount paid to Air Control Products for the specific product or service giving rise to the claim. This section does not limit liability that cannot legally be limited or excluded.

Events Beyond Our Reasonable Control

Except as otherwise provided in a written agreement, Air Control Products is not responsible for delay or failure caused by events beyond its reasonable control, including manufacturer delays, supply shortages, transportation disruptions, labor disputes, severe weather, natural disasters, fire, utility or communications failures, governmental actions, epidemics or public-health events, acts of terrorism or war, or similar circumstances.

Intellectual Property

The Site and its original text, graphics, logos, layout, and other content are owned by Air Control Products or used with permission and are protected by applicable intellectual property laws. Product names, trademarks, photographs, technical data, and other manufacturer materials may be owned by their respective manufacturers or licensors. You may not reproduce, distribute, modify, publish, or commercially exploit Site content without the permission of the applicable rights holder, except as permitted by law.

Third-Party Links and Manufacturer Resources

The Site may link to manufacturer websites, technical resources, or other third-party websites for convenience.
